Schuermans & Schuermans
Lawyers at Schuermans & Schuermans graduated from Belgium's top-tier law schools. Their education often culminated in a post-graduate degree, in specialties such as European law, business law, tax law and insurance law and economics. They all are admitted to the Bar and licensed to appear before any Court (other than the Supreme Court) and Regulatory Agency in Belgium.

Some of them hold a law degree from both a Dutch- and French-speaking law school, and most of them received part of their legal education abroad, including in the Netherlands, France, the United Kingdom, Italy, Spain and the People's Republic of China. Three of them hold an American law degree from such prestigious law schools as Harvard and Duke.

Consequently, fluent knowledge of Dutch, French, English, German, Italian and Spanish is available.

Jean-Luc Schuermans is admitted to the New York Bar and gathered experience with American legal practice as associate with Hughes Hubbard & Reed in New York City.

In view of its lawyers' profiles, Schuermans & Schuermans is increasingly involved in cross-border transactions, litigation and arbitration, representing Belgian as well as foreign clients.

The expertise of Schuermans & Schuermans is further enhanced by the academic functions of its lawyers at some of Belgium's most outstanding (law) schools. Professor Em. Luc Schuermans taught insurance law at the Universiteit Antwerpen Law School until 2005 and Professor Caroline Van Schoubroeck teaches torts and (non-marine) insurance law at the Katholieke Universiteit Leuven, while Jan Surmont teaches environmental (tax) law at the Brugge Business School.

Most of the firm's lawyers publish extensively in their field of practice. A list of publications is available upon request.

Liability and (Non-Marine) Insurance LawIn addition to corporate and regulatory issues facing insurers, the firm's practice covers all legal aspects of liability and (non-marine) insurance, with a particular emphasis on property casualties and fire, fraud, professional liability (of attorneys, 'notaires', accountants, auditors, brokers, bankers, officers and directors), medical malplractice, transport, product liability and all risks liability. It represents the world's leading insurers and insureds, both as plaintiff and defendant, in almost all complex proceedings resulting from major casualties or disasters occuring in Belgium. The firm increasingly is involved in life and group insurance related matters, as well as pension funds.

Commercial, Corporate and Competition LawMost of the firm’s assignments involve a wide range of commercial issues, among others, related to distribution, agency, franchising and other types of business contracts. Its corporate practice involves specialized advisory work, corporate and assets restructuring, joint ventures, mergers and acquisitions, shareholders agreements and day-to-day corporate matters, often involving cross-border aspects. The firm represents both privately held and listed companies, officers, directors and shareholders, either as a plaintiff or defendant, in cases of mismanagement, majority versus minority conflicts, and the exit of shareholders. It also assists in the estate planning for individual owners of family businesses. The firm advises and represents clients not only on fair trade issues and consumer protection matters, but also with respect to both European and Belgian competition law, including mergers and acquisitions review proceedings (Belgian Competition Council).

Intellectual property, Information Technology and Entertainment LawThe firm’s IP practice includes advice on and enforcement of trademarks, patents, design rights and copyrights, as well as negotiating and drafting internet, e-commerce, license and R&D contracts. It has developed a solid reputation in matters involving protection or malfunction of software (including e-commerce applications), representing both (international) software developers and major customers such as banks and insurers. The firm also represents opera singers, a music production company, television directors, local and national television broadcasting networks, and fashion designers.

Banking LawRepresenting some of Europe’s leading financial institutions for decades, the firm has gained particular expertise in securing their interests against (insolvent) debtors and guarantors, which often implies complex litigation, including injunction and attachment proceedings.

Administrative and Regulatory LawThe firm has an extensive practice in constitutional law proceedings (Belgian Constitutional Court) and in administrative law proceedings (Belgian Council of State). It deals with matters involving public agencies and regulated activities and industries, including public procurement issues, government contracts, distribution of utilities, media and telecommunication.

Environmental and Real Estate LawThe firm participates in negotiations with permit-granting agencies, advises in matters related to soil and groundwater contamination and waste management, and also represents clients in civil and criminal proceedings. It offers assistance towards administrative and environmental compliance and advises on zoning law, development and policy. It assists developers, investors, owners and tenants of real estate projects (industrial, office, commercial and private) from the purchase of the land throughout the entire construction process and during the use of such facilities.

Agro-business LawIn addition to advising on general aspects of environmental, regulatory and administrative law, the firm serves most of the legal needs of agro-business, representing among Europe’s largest actors in the veal, pork, poultry, seed and animal feed market.

(Non-Marine) Transport LawWith offices located at the crossroads of Benelux and Germany, in the 'hinterland' of the ports of Antwerp and Rotterdam, a permanent increase of non-marine transport and... casualties causes the firm to represent numerous transportation companies and their insurers.

Tax and Labour LawAt the request of clients, transactions are screened by the firm’s tax lawyers on the impact and consequences thereof, if any. They also have expertise in tax litigation, estate planning and tax-efficient compensation. The firm also advises on all aspects of labour and employment law, including labour representatives, labour conflicts and strikes, pensions and alternative forms of remuneration and benefits.

(White Collar) Criminal LawSince statutes applicable to the above-mentioned practice areas are increasingly providing criminal sanctions for violation thereof, the firm not only offers advice on such matters, but also represents clients in Criminal Courts when such violation is alleged.

Litigation and ArbitrationWith respect to any of the above-mentioned practice areas, Schuermans & Schuermans' lawyers have a well established (and successful) track record in both litigation and arbitration proceedings. Again, they are licensed to appear in Belgium before any (either Dutch- or French-speaking) Court (other than the Supreme Court) or Regulatory Agency. Arbitration is either ad hoc or conducted within the framework of CEPINA or the International Chamber of Commerce, and some lawyers at Schuermans & Schuermans also have experience as arbitrator.
